Data Transfer Agreement (DTA) for the transfer or use of human participant data
The transfer and use of human participant data is highly complex and cannot be easily generalized. Duke researchers in the School of Medicine wishing to transfer or use human participant data should contact the Office of Research Contracts (ORC) early to initiate a discussion on the proposed data transfer or use.
The following information is a summary and not intended to be complete guidance on the transfer or use of data:
Generally the transfer and use of data is governed by various important considerations including those related to Duke IRB rules, the Health Insurance Portability and Accountability Act of 1996, as amended (“HIPAA”), ethical considerations, whether or not the transfer and/or use of the data is subject to contractual constraints, and issues related to intellectual property.
Researchers in the School of Medicine wanting to transfer or use data should contact the Data Front Door via the Duke Data Transfer Intake Form to receive instructions and next steps. This centralized entry point allows for earlier and more comprehensive review of regulatory, security, and cost implications-well before contract/agreement activities begin. The Office of Research Contracts (ORC) will remain involved as the final step - executing agreements only after all necessary evaluations have been completed.

Please note that Duke researchers are not authorized to sign DTAs on behalf of Duke. The DTA must be submitted to ORC to obtain the proper signature.
